There is a lot of stuff that the station ownes, like i think material from atleast a year ago is owned by K-Rock. The "It's just wrong" game is owned by K-Rock, so we might not hear that again. Stuff that has been created within the recent year i think belongs to the Show or to Howard. I remember him talking about this in March i think. Anyhow, i can't wait until next year.
This question actually came up on one of his previous shows. I think that a lot of stuff is still being talked about behind closed doors, but Viacom is claiming a lot of Stern's work as "Intellectual Property". Which is incredible because it was Stern and his crew who had the intellect in the first place to come up with the stuff.
Viacom should just let Stern take his stuff and go whenever he leaves for Sirius. I mean... it's not like anyone else is going to be able to use his stuff and actually pull it off. It's stupid and it is just one more way for Viacom to act like a slave owner.
I don`t C Y they wouldn`t let howard take his work.I don`t think it will ever B played again on terr.radio.If it is played on K-ROCK again it will be bleeped so much it will B unlistenable.Look how lame his show has gotten since the FCC came in 2 save us.
I think it his material and should be allowed to use it on Sirius!
When opie and anthony went to XM, they couldn't take their stuff from wnew, it is owned by infinity. They still play some of it though, but infintiy owns the rights to it.
It all depends on howies contract, hopefully it's his.
When anyone goes to work for a company, and gets paid to produce something, a widget, a engine, a show, etc, anything, the results of that paid work usually belong to the entity paying. This is standard across all industries.
Now the bits themselves could be recreated by Howard, but the tapes of the originals will be vaulted by his current employer, we can bet on that.

It is possible though, that howie had it worked into his old contract that he owns the masters, probably not, but it is possible
Howard brought this up a while ago on the show. Infinity is fighting him. They are saying anything created in house during his employment there is both their property. This means both Howard and Infinity own the property and Infinity won’t let him use it at the new place. They won’t give up their end because old wife doesn’t want to give new wife any of her toys. He did state he owns all E! show material.
Tom did mention they could have the RoboSpanker. LOL

his show has been watered down for years, he just anounced sirius, what, like 7 months ago? Please don't make excuses for him, he does a good enough job on his own.

I remember this came up when Letterman moved from NBC to CBS...they didn't want to let him do the "Top 10" list at CBS because it was their intellectual property. As I remember, he basically just did it anyway, then they worked something out later.

While I agree that it's kinda petty, it's all part of a bigger picture. For example, you have a group of people at General Motors who design a particular vehicle. If they part ways with GM, should they be allowed to take that very same design to a competitor? I don't think so. Even though a radio show isn't something you can hold in your hand, the performers were paid to come up with the material and deliver it on behalf of the company that paid them to do so. Therefore, the company owns the ideas expressed on the air by said performer(s).
If anything, Howard should thank his lucky stars that he's not bound by a non-compete that will keep him off the air for a year or two before he's able to take to the waves on Sirius.

With the agent Howard has, Dan Buckwald sp.?, there is no way he would allow a non compete clause in his contract since radio personalities are fired or let go so often. They have to make a living after all. Howard said he is archiving a lot of material that is edited to death now to play later on Sirius. I wonder if there's going to be a fight over that?
