Lawyers say CBS, Howard Stern close to settling dispute

NEW YORK -- Lawyers on both sides of the CBS Corp. and Howard Stern breach of contract lawsuit said Wednesday they are close to a settlement.
CBS lawyer Irvin Nathan told Judicial Hearing Officer Ira Gammerman, "We have an agreement, but there are details that have to be worked out." He added that the parties were "very close" to a settlement.
Stern's lawyer, Peter Parcher, confirmed Nathan's report but refused to elaborate.
The lawyers told Gammerman they will return to his courtroom next week if they do not conclude the agreement. They said they would notify him by telephone if they resolve the dispute and no longer need the court.
CBS says in its lawsuit, filed in February, that its former star radio shock jock breached his contract with it when he moved to Sirius Satellite Radio Inc.
The lawsuit, which also names Sirius, says Stern improperly used CBS radio's air time to promote his Sirius show, which began in January. CBS also says Stern discussed his plans with Sirius without disclosing them to CBS as his contract required.
Stern moved his popular and bawdy morning show to satellite radio in a five-year, $500 million deal after years of railing against decency restrictions imposed on regular radio by the Federal Communications Commission.
CBS' lawsuit asks that the defendants be forced to return any financial benefits they received from use of CBS radio's air time to promote Sirius.
Howard is not getting his tapes back- if anything, he's paying something here. Best scenario is CBS agreed to drop the suit and Howard agreed to not to counter sue. It's going to be a wash and everyone will walk away with nothing, except the lawyers who will make a few million.

A very good point you make. I don't think we'll ever know the real truth, unless things just start happening. Like old tapes being played.

Oh, I think you can be pretty sure that we'll never know the details. Frankly I'm dissapointed. I thought Howard had a pretty good counter suit- but, when these things drag out (which it would have), it's only the lawyers that win in the end.

I was reading over there as well- If you're talking about Shamela, I'm not seeing many interesting points from her.

Yea, I'm not claiming to know anything (I'm not Winst, by the way) but if it's getting settled this early nobody is getting anything huge. Howard isn't getting his tapes and CBS isn't getting a hundred million. It sounds like a wash. CBS realized their case was questionable and that Howard may have a countersuit and Howard's lawyers realized that maybe CBS had a chance of winning and that the countersuit wasn't going to cover the lawyer bills to win it. It's going to be a wash.
