Default xmp3 radio

Today I took my xm inno back to best buy because my inno died on me last week. I walked back to the satellite radio section and i saw the xmp3 radio picked it up and the dumb guy at the counter said you can't buy this. To make things worse he gives me another inno Im not gonna activate my radio because it could be referbished.

As long as the warrentee remains valid, it shouldn't matter. It should still be a good radio.

Did Best Buy indicate when they will be "allowed to" carry it? Can't find it in NJ.
